Man Fined $1.5 Million For Leaked Mario Game 287

An anonymous reader writes "A Queensland man will have to pay Nintendo $1.5 million in damages after illegally copying and uploading one of its recent games to the internet ahead of its release, the gaming giant says. Nintendo said the loss was caused when James Burt made New Super Mario Bros Wii available for illegal download a week ahead of its official Australian release in November of last year. Nintendo applied for and was granted a search order by the Federal Court, forcing Burt to disclose the whereabouts of all his computers, disks and electronic storage devices in November. He was also ordered to allow access, including passwords, to his social networking sites, email accounts and websites."

Game Devs Migrating Toward iPhone, Away From Wii 143

A new report by Game Developer Research reveals that the number of developers working on games for the iPhone continues to rise, roughly doubling in number from last year. At the same time, the amount of work done on games for Nintendo's Wii dropped significantly: "Just over 70 percent of developers said they were developing at least one game for PC or Mac (including browser and social games), rising slightly from last year; 41 percent reported working on console games. Within that latter group, Xbox 360 was the most popular system with 69 percent of console developers targeting it, followed by 61 percent for PlayStation 3. While those console figures stayed within a few percent of last year's results, the change in Wii adoption was much more significant: reported developer support for the system dropped from 42 percent to 30 percent of console developers, supporting numerous publishers' claims of a recent softening of the Wii market."

The Wii and various mobile gaming platforms have done wonders for the trend toward casual or "easy" games. But the success of a few recent titles, despite their difficulty, has caused some to wonder whether the pendulum has swung too far; whether a little frustration can be seen as a good thing. Quoting: "The evidence is subtle but compelling. For one example, look to major consumer website GameSpot's Game of the Year for 2009: Atlus' PS3 RPG Demon's Souls, which received widespread critical acclaim – none of which failed to include a mention of the game's steep challenge. GameSpot called it 'ruthlessly, unforgivingly difficult.' Demon's Souls was a sleeper hit, an anomaly in the era of accessibility. One would think the deck was stacked against a game that demanded such vicious persistence, such precise attention – and yet a surge of praise from critics and developers alike praised the game for reintroducing the experience of meaningful challenge, of a game that demanded something from its players rather than looked for ways to hand them things. It wasn't just Demon's Souls that recently flipped the proverbial bird to the 'gaming for everyone' trend. Why Has No One Made a Great Gaming Phone? 303

andylim writes "According to Engadget, John Koller, Sony's head of PlayStation marketing, recently said that 'Apple's entrance into the portable gaming space has been a net positive for Sony. When people want a deeper, richer console, they start playing on a PSP.' What's odd though is that everyone knows that the mobile phone gaming market is a huge and yet neither Sony nor Nintendo has made a gaming phone yet. Recombu.com thinks that Nokia could enter the space with PSP-like devices and it has come up with a concept phone called the Ovi Orion, which would bridge the gap between phone and console, 'If the iPhone is Wii, then Ovi Orion would be Xbox and offer Xbox Live style features. A serious gaming phone for serious gamers.'"

New Super Mario Bros. Wii Tops 10 Million Sales 164

According to a report from Japanese publication Nikkei Net, Nintendo's New Super Mario Bros. Wii has now sold 10 million copies worldwide. The game needed only 45 days to pass the already impressive sales numbers of Super Mario Galaxy. Quoting Gamasutra: "NSMB Wii has sold 3 million units in Japan, where it launched on December 3; 3 million copies in Europe, where it launched November 20, and 4.5 million units in North America, where it launched November 15. Super Mario Galaxy has sold 4.1 million units in North America since 2007. The game's design hearkens back to the two-dimensional, side-scrolling style of earlier Mario titles ... The numbers would seem to suggest that these traits successfully generated more mass appeal for NSMB Wii than for the three-dimensional and far less familiar Super Mario Galaxy, which sent the plumber navigating more innovative spherical space environments."

Wii Balance Board Gives $18,000 Medical Device a Run For Its Money 422

Gizmodo highlights a very cool repurposing effort for the Wii's Balance Board accessory. Rather than the specialized force platforms used to quantify patients' ability to balance after a trauma like stroke, doctors at the University of Melbourne thought that a Balance Board might serve as well. Says the article: "When doctors disassembled the board, they found the accelerometers and strain gauges to be of 'excellent' quality. 'I was shocked given the price: it was an extremely impressive strain gauge set-up.'" Games controllers you'd expect to be durable and at least fairly accurate; what's surprising is just how much comparable, purpose-built devices cost. In this case, the Balance Board (just under $100) was compared favorably with a test platform that costs just a shade less than $18,000.

Wii Hardware Upgrade Won't Happen Soon 325

As high-definition graphics become more and more entrenched in this generation of game consoles, Nintendo has had to deal with constant speculation about a new version of the Wii that would increase its capabilities. Today, Nintendo of America president Reggie Fils-Aime bluntly denied that a hardware revision was imminent, saying, "We are confident the Wii home entertainment console has a very long life in front of it." He added, "In terms of what the future holds, we've gone on record to say that the next step for Nintendo in home consoles will not be to simply make it HD, but to add more and more capability, and we'll do that when we've totally tapped out all of the experiences for the existing Wii. And we're nowhere near doing that yet."

Subscribers who have the unlimited streaming service can watch non-HD version of the movies on their Wii with a special Netflix disc inserted." The thing I can't understand is why the PS3 and Wii have to require a disc. Both are capable of downloading applications and executing them. Why should I be required to dedicate my disc slot to stream a movie? Of course, my netflix queue is half-filled with Ken Burns documentaries, so if I lost the disc, I think that would just make the wife happier.

Is Console Gaming Dying? 496

mr_sifter writes "PC gamers love to obsess over whether PC gaming is dying, but bit-tech thinks it's time to look at the other side and examine if console gaming is really as secure as publishers would have us believe. All three console manufacturers suffered from the recession — this year, Sony announced its first net loss in 14 years; a stunning ¥989.9bn, which includes record losses of ¥58.5bn in its gaming sector. Microsoft also announced its first loss since it went public in 1986 in the second quarter of this financial year, with a $31 million US loss coming straight from the Entertainment and Devices division, which is responsible for the Xbox 360. Not even Nintendo has escaped the financial plague either, with sales of the Wii dropping by 67 percent in the US, 60 percent in Japan and 47 percent in the rest of the world. In addition to reduced profitability, casual games and the rise of the iPhone further suggest the current model is not invulnerable."

Mega Man 10 Confirmed For WiiWare 104

The upcoming issue of Nintendo Power revealed that Capcom is working on Mega Man 10 for a release via WiiWare sometime in the future. "Like Mega Man 9 (released for WiiWare in 2008), Mega Man 10 remains true to the series's roots with 8-bit-style graphics and sound, and tried-and-true Mega Man gameplay." According to the early look at Nintendo Power's article, the game may include an easier difficulty mode, likely inspired by complaints that the previous game was too hard. It also previews one of the new bosses, who is apparently called "Sheep Man." Make of that what you wool.

I bought it on the Steam service this weekend for $20 and was impressed that it is a visually and aurally pleasing game. It's a real-time strategy game, but isn't a rehashed Civilization or Age of Empires — it employs a different kind of mechanic to conquer. Like a lot of games that rely on novel game mechanics (Braid & Spore come to mind), part of the game's experience relies on you learning as you progress through the 25 or so levels. They will definitely push you to utilize different strategies and tactics, so don't read this review if you're already planning to play this game, as it'll most likely be filled with spoilers about developing a strategy. I give the game an average 6 out of 10 and would like to say that with titles like Braid and Eufloria out there, 'independent' no longer equates to 'sucks.'" Read on for the rest of his thoughts.

The Changing Face of the Console Wars 223

An article at Gamasutra explores the decisions by Microsoft and Sony to launch significant hardware additions — their respective, upcoming motion-control schemes — in the middle of a console cycle, rather than waiting until the next generations of their systems are ready. It's indicative of a change to the established pattern of console wars; nowadays, it's more about adding features and gadgets to improve existing products than developing entirely new ones. Quoting: "... for Sony and Microsoft, motion controllers are their next-gen consoles. And it's a damn sight easier than launching Xbox 720 or PS4. They can debut these peripherals without needing to engineer completely new boxes for consumers, potentially bundle them over time, and they have a much better chance at getting exclusive games, thanks to the specificity of the hardware (something that's happened a lot for the Wii). Thus, both hardware manufacturers and publishers like EA see these controllers sparking new interest in Xbox 360 and PS3, which will delay the next dreaded console transition for another few years."

New Super Mario Bros. Wii Attempts To Bridge Casual/Hardcore Divide 119

When Nintendo returns to its roots next month by releasing a new, 2-D, side-scrolling Super Mario Bros. game for the Wii, it's trying to do more than simply hop on the retro bandwagon many publishers have ridden in recent months. Speaking at a roundtable discussion in New York this week, Nintendo game designer Shigeru Miyamoto talked about how they're trying to satisfy fans of the series who want challenging gameplay in addition to attracting new or casual players just looking for an entertaining platformer. Quoting: "... you can play the story mode single-player all the way through from beginning to end, and at any point along the way, you can add players from the world map and have up to four players cooperate to complete the levels. And beyond that, there are two dedicated multiplayer modes, one of which is free-for-all, which lets you select the stages from story mode ... so you can easily find the stage you like. And then there’s also a coin battle mode which is a competitive multiplayer mode, in which you’re actually competing for points and you’re getting ranked based on how many points you’ve collected. The free-for-all mode has kind of a similar feel to something like Mario Kart where you just happen to have four people over and you want to sit down and play a quick match in your favorite level."

Wii Update 4.2 Tries (and Fails) To Block Homebrew 520

marcansoft writes "On September 28, Nintendo released a Wii update, titled 4.2. This update was targeted squarely at homebrew, performing sweeping changes throughout the system. It hardly achieved that goal, though, because just two days later a new version of the HackMii installer was released that brings full homebrew capabilities back to all Wii consoles, including unmodified consoles running 4.2. However, as part of their attempt to annoy homebrew users, Nintendo updated the lowest level updateable component of the Wii software stack: boot2 (part of the system bootloader chain). Homebrew users have been using BootMii to patch boot2 in order to gain low level system access and recovery functions (running Linux natively, fixing bricks, etc). The update hasn't hindered this, as users can simply reinstall BootMii after updating (it is compatible with the update). But there's a much bigger problem: Nintendo's boot2 update code is buggy." I've chosen to teach a seminar on 'Home Grown Technology' even though I'm an English teacher and only an amateur techie. If you had thirty minutes, three days a week, for nine weeks, what would you teach a group of high school students? I'm considering the Wii-mote smartboard and multitouch displays, but I'm afraid I'm overreaching."
