New 'Lord of the Rings' Movies Set At Warner Bros 131

Warner Bros. Pictures is revamping the "Lord of the Rings" film franchise. Variety reports: On a Thursday earnings call, Warner Bros. Discovery CEO David Zaslav announced that newly-installed studio leaders Mike De Luca and Pam Abdy have brokered a deal to make "multiple" films based on the beloved J. R. R. Tolkien books. The projects will be developed through WB label New Line Cinema. The first "Lord of the Rings" trilogy, helmed by Peter Jackson, grossed nearly $3 billion worldwide; Jackson's follow-up trilogy based on Tolkien's "The Hobbit" matched those grosses.

No filmmakers have been attached to the projects as yet, but in a statement to Variety, Jackson and his main "Lord of the Rings" collaborators Fran Walsh and Philippa Boyens said Warner Bros. and Embracer "have kept us in the loop every step of the way." "We look forward to speaking with them further to hear their vision for the franchise moving forward," Jackson, Walsh and Boyens said.

A Second Hellboy Reboot is Officially on the Way (theverge.com) 63

An anonymous reader shares a report: Almost two decades after the release of the Guillermo del Toro-directed Hellboy, the character is getting yet another reboot. Millennium Media has confirmed that Hellboy: The Crooked Man will enter production next month in Bulgaria, Deadline reports. Casting for the titular character (originally played by Ron Perlman and then David Harbour) is yet to be announced, but the new film will be directed by Brian Taylor, best known for the Jason Statham action movie Crank.

Perhaps most interesting is that the comics' original creator Mike Mignola has written the script for the upcoming film alongside Chris Golden. Both were reported to have worked on the script for the 2019 reboot by The Hollywood Reporter, though Andrew Cosby ultimately ended up with sole credit for writing the screenplay. The 2019 reboot is widely considered to have been both a commercial and critical failure, bringing in roughly $55 million at the box office on a budget of $50 million.

First Trailer For Tetris Movie Released (polygon.com) 37

Apple has released the first trailer for its movie Tetris, which tells the extraordinary true story of the struggle between Western publishers, Nintendo, and the Soviet Union itself for the rights to Alexey Pajitnov's classic puzzle game. Polygon reports: Taron Egerton plays Henk Rogers, the gaming entrepreneur who was instrumental in discovering Tetris and securing the console gaming rights, thus enabling its release on Nintendo's then-revolutionary Game Boy handheld. To do so, he had to negotiate directly with the Soviet regime, since Communist law dictated that the game belonged to the people of the Soviet Union (read: the government) rather than Pajitnov himself. All sorts of Cold War skullduggery ensued.

It's an incredible tale that forms the centerpiece of David Sheff's classic book Game Over, which chronicles Nintendo's early rise. The film, directed by Jon S. Baird, seems to take a pretty broad approach to the material, drenching it in '80s pop needle drops, car chases (for some reason), retro game effects reminiscent of the dreadful Adam Sandler vehicle Pixels, and Egerton tearing up as he describes "the perfect game." [...] Tetris will stream on Apple TV Plus from March 31.

Super Bowl Ads Feature 'Mario Rap', Pixel Phone, Two Batmen, and Warnings of 'Premature Electrification' (sportingnews.com) 75

Despite the absence of cryptocurrency ads, this year's Super Bowl still managed some geek-friendly advertisements. There was even a riff on "the classic intro from the Super Mario Bros. Super Show, the live-action series that ran from 1989-1991," according to Kotaku: the infamous Mario Rap, which advertised Mario's plumbing business (and in its 2023 version featured the URL for a website).

[T]hat website is indeed up and running, and is everything you would hope it would be from a struggling small business servicing the Brooklyn and Queens areas. There's excessive animation, broken image links, a careers page (still under construction, sadly) and even a novelty mouse cursor.

There were also several ads from major tech companies. Google purchased a long ad touting their Pixel phone's ability to remove people from photos (starring Amy Schumer, Doja Cat, and Giannis Antetokounmpo), while Workday drew attention to its enterprise-grade finance and HR software with an ad in which actual rock stars like Ozzy Osbourne, Joan Jett, blues player Gary Clark and members of KISS all urged the software's corporate users to stop calling themselves "rock stars".

Other tech-company ads aired from E*Trade, SquareSpace, and a star-studded Uber One ad in which rapper Puff Daddy auditions singers for their new jingle.

There were also the obligatory celebrity reunions — like Snoop Dogg and Martha Stewart, or the actors from Breaking Bad. But for comic book geeks, a trailer for D.C.'s new movie The Flash included a surprise appearance by Batman — play by both Ben Affleck and by a 71-year-old Michael Keaton, a full 34 years after Keaton played the caped crusader in Tim Burton's 1989 movie Batman. "Worlds collide in The Flash when Barry uses his superpowers to travel back in time in order to change the events of the past," according to a press release cited by People. James Gunn, director of Guardians of the Galaxy and new co-CEO of DC Studios, recently said, according to Deadline, that The Flash "is probably one of the greatest superhero movies ever made." He added that the film's storyline "resets everything" for the franchise.
The last Blockbuster video rental store in America played its own advertising prank during the Super Bowl. They announced their own ad which could only be viewed on their Instagram feed during halftime -- or in person at their store in Bend, Oregon. But, as CNN points out, "the store is also renting VHS copies of it for $2."

And for those geeks concerned about the drawbacks of climate change-fighting vehicles, RAM trucks ran an ad about "Premature Electrification" — for consumers excited about electric vehicles but "lacking the confidence about getting and being able to keep a charge." (Although a disclaimer printed at the bottom of the ad warned "Get excited, but not too excited. Pre-production model shown. Availability in the U.S. expected late 2024. Range lengthening technology to come later.")

Lego Releases 'Insanely Detailed' Lord of the Rings Set for $500 (cnet.com) 81

In J.R.R. Tolkein's The Two Towers, it's in Elrond's home city of Rivendell that Frodo chooses to destroy the ring of power.

And now Lego has created "a truly grand plastic-brick re-creation," reports CNET — costing $500 (£430, AU$800): The stronghold of the elves is a magical place, a sensation Lego managed to encapsulate in 6,167 pieces of plastic stretching 29.5 inches (75 centimeters) wide. "We know many of our fans have been anticipating a set like this for a long time — but a great Lego The Lord of the Rings set is never late, it arrives precisely when it means to!" said Lego design master Mike Psaiki in a statement Tuesday.

The colorful set is based on the design from the Peter Jackson movies. Lego's vision of Rivendell includes Frodo's bedroom, Elrond's study and the Council Ring where you can assemble the Fellowship. The rest of the set features an elven tower and a gazebo, river and bridge.... The set comes with a large cast of 15 minifigure characters, including Gandalf, Frodo, Samwise, Merry, Pippin, Legolas, Gimli and, of course, Elrond.

Does Thanking Too Many People in the Credits Indicate a Movie is Bad? (stephenfollows.com) 54

Film data researcher Stepehen on his blog: David Wilkinson got in touch yesterday asking for advice on his new crowdfunding campaign. One of the topics he wanted to chat about was the 'cost' of offering a "Thanks" credit to his backers. This involves awarding someone who backs the film a credit on the movie under the "With Thanks" section. This name check would appear at the end of the movie and, crucially, on IMDb. On the face of it, there is no cost to offering an almost infinite number of these as it would just be a case of a longer end credit crawl and IMDb doesn't charge for listing credits.

However, David brought up an anecdote from his time as a distributor. In conversations with fellow film sales professionals, the topic of 'how to spot a bad movie' came up. One participant said that they regard having too many 'With Thanks' credits as a red flag. The others agreed and added that the number of producers listed on a movie was similarly useful in spotting a bad film. These are just the kind of industry beliefs that I love to test. This week I'm going to tackle the 'With Thanks' credits and then next week I'll turn to producing credits. I gathered data on 8,096 movies released in US cinemas between 2000-19 (i.e. pre-pandemic), taking note of their number of credited/thanked individuals, their IMDb score (to stand in for audience views) and Metascore (to sample the views of critics).
Conclusion: "A simple and pleasing result. The industry belief that having more than the average number of people thanked in the credits means the movie is bad is flat-out wrong."

Internet Archive Celebrates 1927 Works' Arrival in Public Domain with Short Film Contest (archive.org) 10

To celebrate this year's "Public Domain Day," the Internet Archive "asked people to submit short films highlighting anything that was going to be made available in the Public Domain in 2023." For the contest, vintage images and sounds were woven into creative films of 2-3 minutes. Many of the films were abstract while others educational, they all showcased the possibility when public domain materials are made openly available and accessible for download. "The Internet Archive has spent 24 years collecting and archiving content from around the world...now is the time to see what people can do with it," said Amir Saber Esfahani, director of special arts projects at the Internet Archive.
The counsel from Creative Commons helped judged all 47 entries, with winners finally chosen "based on creativity, technique, engagement, and variety of 1927 content."

The winning entries include "The Public Domain Race," a montage of newly-uncopyrighted 1927 film clips and cartoons. And the honorable mentions include short films showing, among other things, 2023 filmmaker Sam Dody serenading a lovestruck silent film star from 1927 — and the story of why Mae West once spent eight days in jail.

But the big first-place prize of $1,500 went to Gnats Gonzales for reciting a poem that was emblazoned over the artwork and title pages of 1927 works that have finally entered the public domain. "... Let not kings nor selective texts decide what is known among you. Ignore the temptation of hippocampal decay. Plunge into the dark depths. And feel the warmth of mortal creation at its purest."

That last quote appears over a 1927 movie poster showing a woman smashing pies into the face of Oliver Hardy.

'Avatar: the Way of Water' Beats 'The Force Awakens', Becomes 4th Highest-Grossing Film Ever (variety.com) 112

Avatar: The Way of Water "has passed Star Wars: The Force Awakens as the fourth highest-grossing movie of all time," reports Variety: Director James Cameron's sci-fi epic has now earned $2.075 billion at the global box office. Star Wars: The Force Awakens, another sci-fi sequel released long after previous installments, finished its theatrical run with $2.064 billion after hitting theaters in December 2015.

With this latest box office milestone, Cameron now has three of the top four highest-grossing movies in history — the original Avatar is still the champion [with $2.92 billion], while Titanic sits in third place [with $2.2 billion].

[The second-highest grossing film of all time is Avengers: Endgame with $2.79 billion.] Avatar: The Way of Water has quickly moved up in the record books, surpassing Spider-Man: No Way Home ($1.92 billion) on Jan. 18 and Avengers: Infinity War ($2.05 billion) shortly after on Jan. 26....

A third "Avatar" entry has already been set for release in December 2024 and there are plans for a fourth and fifth to continue the intergenerational saga

Some context from The A.V. Club: The highlight of that big pile of planetary currency being a massive $229 million turnout in China, where it's one of the first Disney movies to play in the country's lucrative markets in some time.

As it happens, James Cameron told GQ back in November, ahead of his sequel's release, that his "fucking expensive" movie would have to post these kinds of numbers to be anything other than a loss for the studio. "You have to be the third or fourth highest-grossing film in history," he noted at the time. "That's your threshold. That's your break even."

Wikipedia points out that when box office figures are adjusted for inflation, the highest-grossing film of all time is still the 1939 Civil War drama Gone with the Wind. And the next top-grossing films of all-time?

Marvel Boss Doesn't Think Audiences Will Ever Get Tired of Superhero Movies (variety.com) 226

Will moviegoers ever get superhero fatigue? Marvel boss Kevin Feige doesn't buy it, saying on a new podcast interview that there are 80 years of "groundbreaking" stories told in the Marvel comics that they can adapt into "different genres." From a report: "I've been at Marvel Studios for over 22 years, and most of us here at Marvel Studios have been around a decade or longer together," Feige said on "The Movie Business Podcast," hosted by Jason E. Squire, an author and professor at the USC School of Cinematic Arts. "From probably my second year at Marvel, people were asking, 'Well, how long is this going to last? Is this fad of comic book movies going to end?'"

Feige continued, "I didn't really understand the question. Because to me, it was akin to saying after 'Gone With the Wind,' 'Well, how many more movies can be made off of novels? Do you think the audience will sour on movies being adapted from books?' You would never ask that because there's an inherent understanding among most people that a book can be anything. A novel can have any type of story whatsoever. So it all depends on what story you're translating. Non-comic readers don't understand that it's the same thing in comics." Referencing the rich catalog of Marvel comics, which date back to 1939, Feige said there are countless stories for the studio to adapt in various genres.

China Lifts Ban On Marvel Movies (variety.com) 49

China has lifted its unofficial ban on Marvel titles, bestowing release dates for two major superhero tentpoles, "Black Panther: Wakanda Forever" and "Ant-Man and The Wasp: Quantumania." Variety reports: "Black Panther: Wakanda Forever," which was released everywhere else in the world last November, will open in China on Feb. 7. Shortly after, "Ant-Man and The Wasp: Quantumania" will be released on Feb. 17, the same day the sequel touches down in the U.S. and the U.K. The dates were released via Marvel's Chinese social media accounts.

Those movies will be the first Marvel adventures to play in China since 2019's "Avengers: Endgame" (which made a staggering $632 million in the territory) and "Spider-Man: Far From Home" (which brought in $198 million in the territory). In the past, Marvel movies have been extremely popular in China, with "Black Panther" grossing $105 million and "Ant-Man and the Wasp" earning $121 million in the country.

It's not clear why recent titles from Disney and other major studios have been denied release in China. But it is most likely sabre rattling directed towards the U.S. during a period of increased tensions, especially with jingoistic political events like the 100th anniversary of the Chinese Communist Party and the 20th National Congress happening in 2021 and 2022 respectively.

'This Film Does Not Exist': AI Imagines Jodorowsky's 'Tron' (nytimes.com) 37

In the mid-1970s, Chilean filmmaker Alejandro Jodorowsky tried to film Dune (working with artists including H.R. Giger). A documentary about that attempt was filmed by Frank Pavich, who now writes in the New York Times that "The cast would have included Mick Jagger, Orson Welles, Salvador Dalí and Alejandro's 12-year-old son, Brontis, in the lead role. The soundtrack would have been composed and recorded by Pink Floyd.... It will forever be the greatest film never made, because it exists solely in our imaginations."

Just because you cannot watch Alejandro's "Dune" doesn't mean it didn't change the world. This unfilmed film's influence on our culture is nothing short of astounding. Specific ideas and images from the "Dune" art bible have escaped into the world. They can be experienced in movies such as "Blade Runner," "Raiders of the Lost Ark," "Prometheus," "The Terminator" and even the original "Star Wars." His "Dune" does not exist, yet it's all around us.
Nearly half a century later... I was recently shown some frames from a film that I had never heard of: Alejandro Jodorowsky's 1976 version of "Tron." The sets were incredible. The actors, unfamiliar to me, looked fantastic in their roles. The costumes and lighting worked together perfectly. The images glowed with an extravagant and psychedelic sensibility that felt distinctly Jodorowskian.

However, Mr. Jodorowsky, the visionary Chilean filmmaker, never tried to make "Tron." I'm not even sure he knows what "Tron" is. And Disney's original "Tron" was released in 1982. So what 1970s film were these gorgeous stills from...? The truth is that these weren't stills from a long-lost movie. They weren't photos at all. These evocative, well-composed and tonally immaculate images were generated in seconds with the magic of artificial intelligence.

The article notes that the real Jodorowsky is now almost 94 — and is planning to direct a new film. But it also points out that in the early 1970s Jodorowsky's team put in "two years of pure analog struggle to create his Dune," — while Canadian film director Johnny Darrell generated the Tron images in less than a minute using an A.I. program called Midjourney. Pavich says this raises several questions. "Has Alejandro been robbed? Is the training of this A.I. model the greatest art heist in history? How much of art-making is theft, anyway?"

In his great documentary F for Fake Orson Welles intones wrly that "A forgery — is still a painting." So Pavich's piece concludes with perhaps the ultimate question. "What will it mean when directors, concept artists and film students... can paint using all the digitally archived visual material of human civilization? When our culture starts to be influenced by scenes, sets and images from old films that never existed or that haven't yet even been imagined?

"I have a feeling we're all about to find out."

Woman Ordered To Repay Employer After Software Shows 'Time Theft' (theguardian.com) 167

An anonymous reader quotes a report from The Guardian: A Canadian woman has been ordered by a civil tribunal to compensate her former employer for "time theft" after she was caught misrepresenting hours worked by controversial tracking software. Karlee Besse, who worked remotely as an accountant in British Columbia, initially claimed she was fired from her job without cause last year and sought $3,729 in compensation -- both in unpaid wages and severance. But the company, Reach CPA, told the tribunal Beese had logged more than 50 hours that "did not appear to have spent on work-related tasks."

Reach said it installed employee-tracking software called TimeCampon Besse's work laptop after it found her assigned files were over budget and behind schedule, a strategy companies are increasingly taking in the era of remote work. The software tracks how long a document is open, how the employee uses the document and logs the time as work. Weeks later, the company said an analysis "identified irregularities between her timesheets and the software usage logs." While Besse told the tribunal she found the program "difficult" and worried it didn't differentiate between work and personal use, the company demonstrated how TimeCamp automatically makes those distinctions, separating time logs for work from activities such as using the laptop to stream movies and television shows.

Besse said she had printed documents to work on, but did not tell Reach she was using hard copy because she "knew they wouldn't want to hear that" and she was afraid of repercussions. The company said that the software also tracks printing -- and that few documents had been logged as printed. It also said any work from the printed documents would have needed to be input into the company's software, which never happened. [...] The judge tossed out Besse's claim of wrongful termination and ordered her to pay $1,840.27, both in returned wages and as a part of previous advance she had received from the company.

Belarus Legalizes Piracy of Movies, Music and Software of 'Unfriendly' Nations (torrentfreak.com) 198

AmiMoJo writes: Belarusian dictator Alexander Lukashenko has signed a new law that legalizes piracy of movies, music, TV shows and software owned by rightsholders from 'unfriendly countries'. The law also allows goods protected by intellectual property law to be imported from any country without obtaining permission from rightsholders.

Lukashenko's support for Russia's invasion of Ukraine led to new sanctions being imposed by the EU, U.S. and other countries. In common with Russia, Belarus relies on intellectual property owned by foreign rightsholders that are currently unable or unwilling to supply and/or license it. So, to ensure legal access to pirated movies, music, TV shows and software, the government drafted a new law to restrict intellectual property rights.

Samsung Bets On MicroLED and 8K For Its Premium 2023 TVs (engadget.com) 42

Four years after introducing its MicroLED technology at CES 2018, Samsung claims the technology is ready for the masses and "will set the standard for picture quality in 2023," reports Engadget. From the report: At CES 2023, the company announced it would offer 50-, 63-, 76-, 89-, 101-, 114- and 140-inch MicroLED models, greatly expanding the amount of choice consumers have when it comes to the new display technology. Samsung didn't provide pricing and availability information for the expanded line, but the company claims the new models are its most affordable MicroLED TVs to date. [...] The set sports a 240Hz variable refresh rate and 2-nanosecond response time. It also offers 20-bit black detail for "intense" contrast.

Samsung is also promising upgrades for its Neo QLED sets, starting with the line's new flagship. The QN900C features an 8K Quantum MiniLED-lit panel capable of maxing out at 4,000 nits of brightness. As with Samsung's 2022 Neo QLED sets, the QN900C features a 14-bit backlight. However, the TV offers even better contrast thanks to a tweak the company made to its 8K Real Depth Enhancer Pro software. Samsung is also promising improved picture quality when viewing older movies and TV shows thanks to the inclusion of its new Auto HDR Remastering algorithm, which can automatically apply HDR effects to standard dynamic range content.

For those who would prefer a 4K set, there's also the QN935C. Samsung's new 4K flagship features a redesigned power board that eliminates the need for an external connection box and allows for bezels that are less than 20mm thick. The QN935C also features top-firing speakers, allowing the set to produce Dolby Atmos sound without a dedicated soundbar. You can use both the QN900C and QN935C as a smart home hub thanks to the fact Samsung's entire 2023 Neo QLED line will feature built-in Zigbee and Matter Thread all-in-one modules.
As for its OLED models, Samsung announced the 2023 QD-OLED TV line, which will offer up to 2,000 nits of peak brightness and support 144Hz refresh rates -- all while being more energy efficient than before. "Additionally, the company has gone out of its way to get the panels AMD FreeSync Premium Pro certified," adds Engadget.

Chinese Researchers Claim To Find Way To Break Encryption Using Quantum Computers (ft.com) 50

Computer security experts were struggling this week to assess a startling claim by Chinese researchers that they have found a way to break the most common form of online encryption [the link may be paywalled] using the current generation of quantum computers, years before the technology was expected to pose a threat. Financial Times: The method, outlined in a scientific paper [PDF] published in late December, could be used to break the RSA algorithm that underpins most online encryption using a quantum machine with only 372 qubits -- or quantum bits, a basic unit of quantum computing -- according to the claims from 24 researchers from a number of academic bodies and state laboratories. IBM has already said that its 433 qubit Osprey system, the most powerful quantum computer to have been publicly unveiled, will be made available to its customers early this year.

If correct, the research would mark a significant moment in the history of computer security, said Roger Grimes, a computer security expert and author. "It's a huge claim," he said. "It would mean that governments could crack other governments secrets. If it's true -- a big if -- it would be a secret like out of the movies, and one of the biggest things ever in computer science." Other experts said that while the theory outlined in the research paper appeared sound, trying to apply it in practice could well be beyond the reach of today's quantum technology. "As far as I can tell, the paper isn't wrong," said Peter Shor, the Massachusetts Institute of Technology scientist whose 1994 algorithm proving that a quantum machine could defeat online encryption helped to trigger a research boom in quantum computing. Shor's method requires machines with many hundreds of thousands, or even millions, of qubits, something that many experts believe is a decade or more away.

Asus Brings Glasses-Free 3D To OLED Laptops (arstechnica.com) 22

During the CES 2023 in Las Vegas today, Asus announced an upcoming feature that allows users to view and work with content in 3D without wearing 3D glasses. Ars Technica reports: Similar technology has been used in a small number of laptops and displays before, but Asus is incorporating the feature for the first time in OLED laptop screens. Combined with high refresh rates, unique input methods like an integrated dial, and the latest CPUs and laptop GPUs, the company is touting the laptops with the Asus Spatial Vision feature as powerful, niche options for creative professionals looking for new ways to work.

Asus' Spatial Vision 3D tech is debuting on two laptops in Q2 this year: the ProArt Studiobook 16 3D OLED (H7604) and Vivobook Pro 16 3D OLED (K6604). The laptops each feature a 16-inch, 3200x2000 OLED panel with a 120 Hz refresh rate. The OLED panel is topped with a layer of optical resin, a glass panel, and a lenticular lens layer. The lenticular lens works with a pair of eye-tracking cameras to render real-time images for each eye that adjust with your physical movements. In a press briefing, an Asus spokesperson said that because the OLED screens claim a low gray-to-gray response time of 0.2 ms, as well as the extremely high contrast that comes with OLED, there's no crosstalk between the left and right eye's image, ensuring more realistic looking content. However, Asus' product pages for the laptops acknowledge that experiences may vary, and some may still suffer from "dizziness or crosstalk due to other reasons, and this varies according to the individual." Asus said it's looking to offer demos to users, which would be worth trying out before committing to this unique feature.

On top of the lenticular lens is a 2D/3D liquid crystal switching layer, which is topped with a glass front panel with an anti-reflective coating. According to Asus, it'll be easy to switch from 2D mode to 3D and back again. When the laptops aren't in 3D mode, their display will appear as a highly specced OLED screen, Asus claimed. The laptops can apply a 3D effect to any game, movie, or content that supports 3D. However, content not designed for 3D display may appear more "stuttery," per a demo The Verge saw. The laptops are primarily for workers working with and creating 3D models and content, such as designers and architects. The two laptops will ship with Spatial Vision Hub software. It includes a Model Viewer, Player for movies and videos, Photo Viewer for transforming side-by-side photos shot with a 180-degree camera into one stereoscopic 3D image, and Connector, a plug-in that Asus' product page says is compatible with "various apps and tools, so you can easily view any project in 3D."

Guess what's finally entering America's public domain today? Appropriately enough, it's Marcel Proust's 1927 novel Remembrance of Things Past.

Also entering the public domain today are thousands of other books, plus the music and lyrics of hundreds of songs, and even several silent movies.

Fritz Lang's sci-fi classic Metropolis enters the public domain today — and so does the Laurel & Hardy comedy Battle of the Century (which culminates with one of Hollywod's first pie fights), according to Duke University's Center for the Study of the Public Domain: This is actually the second time that Metropolis has gone into the US public domain. The first was in 1955, when its initial 28-year term expired and the rights holders did not renew the copyright. Then in 1996 a new law restored the copyrights in qualifying foreign works. Metropolis, along with thousands of other works, was pulled out of the public domain, and now reenters it after the expiration of the 95-year term, with the once missing scenes available for anyone to reuse.
They also note that some material is in the public domain from the beginning, including government works like the images from the James Webb telescope.

But for other works, today is a big and important day, writes the Associated Press: Alongside the short-story collection "The Case-Book of Sherlock Holmes," books such as Virginia Woolf's "To The Lighthouse," Ernest Hemingway's "Men Without Women," William Faulkner's "Mosquitoes" and Agatha Christie's "The Big Four" — an Hercule Poirot mystery — will become public domain as the calendar turns to 2023. Once a work enters the public domain it can legally be shared, performed, reused, repurposed or sampled without permission or cost.

The works from 1927 were originally supposed to be copyrighted for 75 years, but the 1998 Copyright Term Extension Act delayed opening them up for an additional 20 years. While many prominent works on the list used those extra two decades to earn their copyright holders good money, a Duke University expert says the copyright protections also applied to "all of the works whose commercial viability had long subsided."

"For the vast majority — probably 99% — of works from 1927, no copyright holder financially benefited from continued copyright. Yet they remained off limits, for no good reason," Jennifer Jenkins, director of Duke's Center for the Study of the Public Domain, wrote in a blog post heralding "Public Domain Day 2023." That long U.S. copyright period meant many works that would now become available have long since been lost, because they were not profitable to maintain by the legal owners, but couldn't be used by others. On the Duke list are such "lost" films like Victor Fleming's "The Way of All Flesh" and Tod Browning's "London After Midnight...."

The UK-based newspaper the Observer adds: For those readers who do not reside in the US, there is perhaps another reason for celebrating today, because copyright terms are longer in the US than they are in other parts of the world, including the EU and the UK. And therein lies a story about intellectual property laws and the power of political lobbying in a so-called liberal democracy.... The term was gradually lengthened in small increments by Congress until 1976, when it was extended by 19 years to 75 years and then in 1998 by the Sonny Bono Act. So, as the legal scholar Lawrence Lessig puts it, "in the 20 years after the Sonny Bono Act, while 1 million patents will pass into the public domain, zero copyrights will pass into the public domain by virtue of the expiration of a copyright term"....

[T]he end result is that American citizens have had to wait two decades to be free to adapt and reuse works to which we Europeans have had easy access....

The issue highlighted by Public Domain Day is not that intellectual property is evil but that aspects of it — especially copyright — have been monopolised and weaponised by corporate interests and that legislators have been supine in the face of their lobbying. Authors and inventors need protection against being ripped off. It's obviously important that clever people are rewarded for their creativity and the patent system does that quite well. But if a patent only lasts for 20 years, why on earth should copyright last for life plus 70 years for a novel?

Artists Opposing AI Image Generators Use Mickey Mouse to Goad Copyright Lawsuits (dailydot.com) 149

AI tools like DALL-E 2, Lensa AI, and Midjourney "can be told to create imagery in the style of a particular artist," notes this article in the Daily Dot.

Yet "The current legal consensus, much to the chagrin of many artists, concludes that AI-generated art is in the public domain and therefore not copyrighted." So... In response to concerns over the future of their craft, artists have begun using AI systems to generate images of characters including Disney's Mickey Mouse. Given Disney's history of fierce protection over its content, the artists are hoping the company takes action and thus proves that AI art isn't as original as it claims. Over the weekend, Eric Bourdages, the Lead Character Artist on the popular video game Dead by Daylight, urged his followers to create and sell merchandise using the Disney-inspired images he created using Midjourney.... "Legally there should be no recourse from Disney as according to the AI models TOS these images transcends copyright and the images are public domain."

Bourdages tweet quickly racked up more than 37,000 likes and close to 6,000 shares.

In numerous follow-up tweets, Bourdages generated images of other popular characters from movies, video games, and comic books, including Darth Vader, Spider-Man, Batman, Mario, and Pikachu.

"More shirts courtesy of AI," he added. "I'm sure, Nintendo, Marvel, and DC won't mind, the AI didn't steal anything to create these images, they are completely 100% original...."

Just two days after sharing the images, however, Bourdages stated on Twitter that he had suddenly lost his access to Midjourney.

The article notes that Bourdages reiterated his point in a later tweet. "People's craftsmanship, time, effort, and ideas are being taken without their consent and used to create a product that can blend it all together and mimic it to varying degrees."

Amazon Acquires Film Rights To 'Warhammer 40,000' (arstechnica.com) 44

Longtime williamyf writes: Both ArsTechnica and The Register report that Amazon, Vertigo, and Games Worksop have entered a preliminary deal for the movie, TV, and merchandising rights of the Warhammer 40K franchise. The deal also brings Henry Cavill -- longtime Warhammer 40K fan, actor who played Geralt in Netflix's The Witcher series and Superman in the Zack Snyder DC superhero films -- as both executive producer and actor.

While this is only a memorandum of understanding, it's highly likely that the deal will pass. What is still not clear is if this will be handled by MGM (meaning a higher probability of theatrical releases and physical media) or if it will go to Amazon Studios (increasing the probability of a streaming-only affaire), or both.

DeepMind Created An AI Tool That Can Help Generate Rough Film and Stage Scripts 26

Alphabet's DeepMind has built an AI tool that can help generate rough film and stage scripts Engadget's Kris Holt reports: Dramatron is a so-called "co-writing" tool that can generate character descriptions, plot points, location descriptions and dialogue. The idea is that human writers will be able to compile, edit and rewrite what Dramatron comes up with into a proper script. Think of it like ChatGPT, but with output that you can edit into a blockbuster movie script. To get started, you'll need an OpenAI API key and, if you want to reduce the risk of Dramatron outputting "offensive text," a Perspective API key. To test out Dramatron, I fed in the log line for a movie idea I had when I was around 15 that definitely would have been a hit if Kick-Ass didn't beat me to the punch. Dramatron quickly whipped up a title that made sense, and character, scene and setting descriptions. The dialogue that the AI generated was logical but trite and on the nose. Otherwise, it was almost as if Dramatron pulled the descriptions straight out of my head, including one for a scene that I didn't touch on in the log line.

Playwrights seemed to agree, according to a paper (PDF) that the team behind Dramatron presented today. To test the tool, the researchers brought in 15 playwrights and screenwriters to co-write scripts. According to the paper, playwrights said they wouldn't use the tool to craft a complete play and found that the AI's output can be formulaic. However, they suggested Dramatron would be useful for world building or to help them explore other approaches in terms of changing plot elements or characters. They noted that the AI could be handy for "creative idea generation" too. That said, a playwright staged four plays that used "heavily edited and rewritten scripts" they wrote with the help of Dramatron. DeepMind said that in the performance, experienced actors with improv skills "gave meaning to Dramatron scripts through acting and interpretation."
