schliz writes "Free software activist Richard Stallman has called for the end of the 'war on sharing' at the World Computer Congress in Brisbane, Australia. He criticized surveillance, censorship, restrictive data formats, and software-as-a-service in a keynote presentation, and asserted that digital society had to be 'free' in order to be a benefit, and not an attack. Earlier in the conference, Stallman had briefly interrupted a European Patent Office presentation with a placard that said: 'Don't get caught in software patent thickets.' He told journalists that the Patent Office was 'here to campaign in favor of software patents in Australia,' arguing that 'there's no problem that requires a solution with anything like software patents.'"

CWmike writes "Hewlett-Packard is reported to be suing former CEO Mark Hurd, who was named co-president of rival Oracle on Monday. The Wall Street Journal first reported the news, and has now posted the full text of the suit on Google Docs. Among other things, it says, 'In his new positions, Hurd will be in a situation in which he cannot perform his duties for Oracle without necessarily using and disclosing HP's trade secrets and confidential information to others.'"

Mapquest supports the project with money for equipment and access to the code they've written to integrate OSM's work with their display. Bing? They just take from the project and do nothing for it in return. This may be okay in a legal sense, but it is a seriously nekulturny way to behave. Even so, having Microsoft's Bing as a reference might help the project's founder make money. They've put a lot of work into this project, and it's doing a lot of people a lot of good, so they certainly deserve some sort of payback, either direct or indirect. They have a few ideas about how they might legitimately earn a few bucks from their project while remaining free software purists. Do you have any ideas, yourself, about how they might turn a few bucks from OSM?"

The result is that glibc, portmap and NFS are no longer tainted."

Stoobalou writes "A shareholding company launched a lawsuit against Hewlett-Packard's board of directors earlier this week, claiming they bungled their fiduciary duties over the departure of CEO Mark Hurd. 'The HP board put shareholders' finances at risk by not telling them about the sexual harassment inquiry, and then later rewarded Hurd with an estimated $40 million severance package, the suit said. The board also failed to adequately police insider trading by HP executives, allowing Hurd and chief financial officer Cathie Lesjak to sell off HP stock in the midst of the inquiry, according to the suit, which was filed in California Superior Court.'" HP is also facing increased scrutiny from the unrelated bribery probe that began earlier this year when their Moscow offices were raided.

fishthegeek writes "The Software Freedom Conservancy has received a judgement against Westinghouse Digital Electronics for $90,000 in damages, $50,000 in costs plus a donation of all of the offending HDTV's that were using BusyBox in violation of the GPL. Given that WDE is nearly bankrupt it's likely that most if not all of the cash will disappear in a legal 'poof,' but it is a victory regardless."

An anonymous reader points out Glyn Moody's thought experiment: what if Oracle bought up the entire open source ecosystem? Who would win, who would lose? And how might an open ecosystem grow in the wake of such an event? "Recently, there was an interesting rumour circulating that Oracle had a war chest of some $70 billion, and was going on an acquisition spree. Despite the huge figure, it had a certain plausibility, because Oracle is a highly successful company with deep pockets and an aggressive management. The rumour was soon denied, but suppose Oracle decided to spend, if not $70 billion, say $10 billion in an efficient way: how might it do that? One rather dramatic use of that money would be to buy up the leading open source companies — all of them."

An anonymous reader writes "Matt Mullenweg (the creator of open source blog software WordPress), after review by various legal experts, is sticking to his guns that themes and plugins that 'extend' WordPress violate the GPL if they are not themselves distributed under the GPL. Matt has gone so far as to post this on Twitter. According to Matt, the premium template called Thesis should be under the GPL and the owner is not happy about it. WordPress is willing to sue the maker of Thesis theme for not following GPL licensing. The webmasters and Thesis owners are also confused with new development. Mark Jaquith wrote an excellent technical analysis of why WordPress themes inherit the GPL. This is why even if Thesis hadn't copy-and-pasted large swathes of code from WordPress (and GPL plugins) its PHP would still need to be under the GPL."

The Register reports that the original system, TACO, has become proprietary, and has added new 'features' best described as bloatware. I guess this should serve as a warning for users to always prefer software under a copyleft license where possible. If Google had chosen a license with better protection, such as the GPL, when it released its own opt-out tool, this problem would have been much less likely. This also shows why forks are so important when software development begins to get messy."

azop writes "Today Bluecherry released a GPL'd driver for its multiple-input MPEG-4 hardware compression cards. The driver supports audio and video capture from 4-, 8-, and 16-channel single-card encoders using the Video4Linux and ALSA APIs. More information about the driver and its features can be found on Bluecherry's development blog and on Ben Collins' personal blog. Bluecherry is the first Linux software company to release a complete driver based on Linux kernel APIs (Video4Linux and ALSA) for multiple-input hardware-compressed MPEG-4 capture cards under the GPL. The cards are designed for security applications (digital video recording), but other applications could potentially make use of the compressed streams and Video4Linux API integration. An H.264 version is 'in the works.'"

Roblimo writes "Zappa's 'Dinah-Moe Hummm' is totally about Linux, at least in spirit, while the song 'Montana,' with its talk of zirconium-encrusted tweezers and dental floss, 'is obviously about Mac users.' Not only that: In the early '70s Zappa wrote a song called 'Penguin in Bondage,' an obvious foretelling of the anti-Linux lawsuits and threats from SCO, Microsoft, and other evildoers. Zappa was also a heavy user of the Synclavier, an electronic music machine that was a precursor to today's 'studio on a computer' recording and sound editing software. According to an article on DevX, today Zappa would no doubt be using Linux and Ardour for most of his recording and composition."

An anonymous reader writes "CodeSourcery's Mark Mitchell wrote to the GCC mailing list yesterday reporting that 'the GCC Steering Committee and the FSF have approved the use of C++ in GCC itself. Of course, there's no reason for us to use C++ features just because we can. The goal is a better compiler for users, not a C++ code base for its own sake.' Still undecided is what subset of C++ to use, as many contributors are experts in C, but novices in C++; there is a call for a volunteer to develop the C++ coding standards."

Most sources say that the proposed legislation is very similar to Bill C-61, generally dubbed the 'Canadian DMCA.' It still includes definitions of 'technological protections' and criminalizes 'circumvention' of those protections. Bill C-61 died in the summer of 2008, facing massive opposition from the Canadian public. Once again, it's time for Canadians to get politically active; ORC ran a large campaign with the last attempt, and will likely be updated soon with the new proposed legislation."
