Western Digital Says Hackers Stole Data in Network Security Breach (techcrunch.com) 7

Data storage giant Western Digital has confirmed that hackers exfiltrated data from its systems during a "network security incident" last week. From a report: The California-based company said in a statement on Monday that an unauthorized third party gained access to "a number" of its internal systems on March 26. Western Digital hasn't confirmed the nature of the incident or revealed how it was compromised, but its statement suggests the incident may be linked to ransomware. [...] Western Digital notes that the incident "has caused and may continue to cause disruption" to the company's business operations.

AM Radio to Be Dropped in All Ford New Models Except Commercial Vehicles (freep.com) 145

It's not just the Ford Mustang that's losing its AM radio. The Detroit Free Press reports: "We are transitioning from AM radio for most new and updated 2024 models," Ford spokesman Wes Sherwood told the Free Press. "A majority of U.S. AM stations, as well as a number of countries and automakers globally, are modernizing radio by offering internet streaming through mobile apps, FM, digital and satellite radio options. Ford will continue to offer these alternatives for customers to hear their favorite AM radio music, news and podcasts as we remove amplitude modulation — the definition of AM in this case — from most new and updated models we bring to market." Commercial vehicles will continue to offer AM radio because of longstanding contract language, Sherwood said....

"In essence, EV motors generate a lot of electromagnetic interference that affects the frequencies of AM radio and make it difficult to get a clear signal," said Mike Ramsey, an analyst with Stamford, Connecticut-based Gartner Research Group, which specializes in digital transformation and innovation. "It could be shielded, but given the diminishing listening habits to AM, the automakers haven't chosen to do it. Most of the content there is available through other means, including podcast and internet streaming. In my view, this isn't that different from automakers discontinuing 8-track players, cassette players and CD players. Technology has advanced. The idea that it is a critical safety channel is a bit suspect given that almost all critical communication now is sent through mobile phones...."

Veteran analyst John McEloy, host of "Autoline After Hours" webcast and podcast said automakers don't need to get rid of AM radio. "It's happening because automakers would love to get rid of the cost of an AM radio," he told the Free Press. "Some of them, like Ford, are using EVs as an excuse to get rid of it. GM shields its AM radios in its electric cars to they don't get any interference."

But the article also quotes a spokesperson for GM saying they're "evaluating AM radio on future vehicles and not providing any further details at this time."

Last month U.S. Senator Markey noted that seven more top automakers have already removed AM radio from their electric vehicles — BMW, Mazda, Polestar, Rivian, Tesla, Volkswagen, and Volvo.

Magnon-Based Computation Could Signal Computing Paradigm Shift (phys.org) 19

An anonymous reader quotes a report from Phys.Org: Like electronics or photonics, magnonics is an engineering subfield that aims to advance information technologies when it comes to speed, device architecture, and energy consumption. A magnon corresponds to the specific amount of energy required to change the magnetization of a material via a collective excitation called a spin wave. Because they interact with magnetic fields, magnons can be used to encode and transport data without electron flows, which involve energy loss through heating (known as Joule heating) of the conductor used. As Dirk Grundler, head of the Lab of Nanoscale Magnetic Materials and Magnonics (LMGN) in the School of Engineering explains, energy losses are an increasingly serious barrier to electronics as data speeds and storage demands soar. "With the advent of AI, the use of computing technology has increased so much that energy consumption threatens its development," Grundler says. "A major issue is traditional computing architecture, which separates processors and memory. The signal conversions involved in moving data between different components slow down computation and waste energy."

This inefficiency, known as the memory wall or Von Neumann bottleneck, has had researchers searching for new computing architectures that can better support the demands of big data. And now, Grundler believes his lab might have stumbled on such a "holy grail". While doing other experiments on a commercial wafer of the ferrimagnetic insulator yttrium iron garnet (YIG) with nanomagnetic strips on its surface, LMGN Ph.D. student Korbinian Baumgaertl was inspired to develop precisely engineered YIG-nanomagnet devices. With the Center of MicroNanoTechnology's support, Baumgaertl was able to excite spin waves in the YIG at specific gigahertz frequencies using radiofrequency signals, and -- crucially -- to reverse the magnetization of the surface nanomagnets. "The two possible orientations of these nanomagnets represent magnetic states 0 and 1, which allows digital information to be encoded and stored," Grundler explains.

The scientists made their discovery using a conventional vector network analyzer, which sent a spin wave through the YIG-nanomagnet device. Nanomagnet reversal happened only when the spin wave hit a certain amplitude, and could then be used to write and read data. "We can now show that the same waves we use for data processing can be used to switch the magnetic nanostructures so that we also have nonvolatile magnetic storage within the very same system," Grundler explains, adding that "nonvolatile" refers to the stable storage of data over long time periods without additional energy consumption. It's this ability to process and store data in the same place that gives the technique its potential to change the current computing architecture paradigm by putting an end to the energy-inefficient separation of processors and memory storage, and achieving what is known as in-memory computation.
The research has been published in the journal Nature Communications.

GM Plans To Phase Out Apple CarPlay In EVs, With Google's Help (reuters.com) 121

General Motors plans to phase out widely-used Apple CarPlay and Android Auto technologies that allow drivers to bypass a vehicle's infotainment systems, shifting instead to built-in infotainment systems developed with Google for future electric vehicles. Reuters reports: GM's decision to stop offering those systems in future electric vehicles, starting with the 2024 Chevrolet Blazer, could help the automaker capture more data on how consumers drive and charge EVs. GM is designing the on-board navigation and infotainment systems for future EVs in partnership with Alphabet's Google. GM has been working with Google since 2019 to develop the software foundations for infotainment systems that will be more tightly integrated with other vehicle systems such as GM's Super Cruise driver assistant. The automaker is accelerating a strategy for its EVs to be platforms for digital subscription services.

GM would benefit from focusing engineers and investment on one approach to more tightly connecting in-vehicle infotainment and navigation with features such as assisted driving, Edward Kummer, GM's chief digital officer, and Mike Hichme, executive director of digital cockpit experience, said in an interview. "We have a lot of new driver assistance features coming that are more tightly coupled with navigation," Hichme told Reuters. "We don't want to design these features in a way that are dependent on person having a cellphone."

Buyers of GM EVs with the new systems will get access to Google Maps and Google Assistant, a voice command system, at no extra cost for eight years, GM said. GM said the future infotainment systems will offer applications such as Spotify's music service, Audible and other services that many drivers now access via smartphones. "We do believe there are subscription revenue opportunities for us," Kummer said. GM Chief Executive Mary Barra is aiming for $20 billion to $25 billion in annual revenue from subscriptions by 2030.

Banks Warier of Serving Crypto Clients After Blowups, Scrutiny 26

US banks, already hesitant to work with crypto customers, are now even warier of providing services to the industry after a string of regional-lender collapses and amid heightened scrutiny by regulators. From a report: The closure of crypto-friendly Silvergate Capital and seizure of Signature Bank has left crypto firms struggling to find new banks for depository and payment services. While there's no blanket ban on serving crypto clients, financial firms are imposing lengthy application procedures, turning away smaller companies and some retail platforms, and in some cases shutting the door on crypto businesses altogether, according to industry participants, investors and bank executives.

Cross River Bank, for example, received requests from more than 100 new clients -- not all of whom were crypto companies -- seeking a safe harbor for their deposits within days of SVB Financial Group's Silicon Valley Bank and Signature collapsing, according to a person with direct knowledge of the bank's business. The closely held company turned down almost all those requests, the person said. Among the few crypto companies that have won over the bank is stablecoin issuer Circle Internet Financial, which expanded a partnership with Cross River, announced after Silicon Valley Bank failed. Earlier this month, lenders that were bidding to buy failed Signature Bank from the Federal Deposit Insurance Corp. specifically asked not to take on the digital-assets business, according to a person familiar with the process. Signature's crypto business was not part of the eventual takeover by New York Community Bancorp, and the FDIC is still seeking to sell Signet, Signature's real-time payments network for crypto firms.

US, Partner Countries Call For Controls To Counter Misuse of Spyware (reuters.com) 18

The United States and some of its partner countries on Thursday called for strict domestic and international controls to counter the proliferation and misuse of commercial spyware. From a report: The joint statement was issued by the governments of Australia, Canada, Costa Rica, Denmark, France, New Zealand, Norway, Sweden, Switzerland, the United Kingdom, and the United States. The countries said they were committed to preventing the export of technology and equipment to end-users who are likely to use them for "malicious cyber activity." The joint statement also said the countries would share information with each other on spyware proliferation and misuse, including to better identify these tools. On Monday, U.S. President Joseph Biden signed an executive order intended to curb the malicious use of digital spy tools around the globe targeting U.S. personnel and civil society. The new executive order was designed to apply pressure on the secretive industry by placing new restrictions on U.S. government defense, law enforcement and intelligence agencies' purchasing decisions.

FTC Should Stop OpenAI From Launching New GPT Models, Says AI Policy Group (theverge.com) 56

An artificial intelligence-focused tech ethics group has asked the Federal Trade Commission to investigate OpenAI for violating consumer protection rules, arguing that the organization's rollout of AI text generation tools has been "biased, deceptive, and a risk to public safety." From a report: The Center for AI and Digital Policy (CAIDP) filed its complaint today following the publication of a high-profile open letter calling for a pause on large generative AI experiments. CAIDP president Marc Rotenberg was one of the letter's signatories, alongside a number of AI researchers and OpenAI co-founder Elon Musk. Similar to that letter, the complaint calls to slow down the development of generative AI models and implement stricter government oversight.

The CAIDP complaint points out potential threats from OpenAI's GPT-4 generative text model, which was announced in mid-March. They include ways that GPT-4 could produce malicious code and highly tailored propaganda as well as ways that biased training data could result in baked-in stereotypes or unfair race and gender preferences in things like hiring. It also points out significant privacy failures with OpenAI's product interface -- like a recent bug that exposed OpenAI ChatGPT histories and possibly payment details to other users.

SEC Chair Gensler: Existing Rules Regulate Crypto, Legislation Unnecessary (theblock.co) 23

The Securities and Exchange Commission takes the lead in defining what a security is, not necessarily legislation, the regulator's Chair Gary Gensler said. From a report: After a House Appropriations Committee hearing on Wednesday, Gensler told reporters that existing securities laws "cover most of the activity that's happening in the crypto markets. If Congress were to act, though I don't think we need these authorities, not to undermine inadvertently through definitions of what's in or out, or in essence allowing for conflicts that we don't allow," Gensler said.

"I think there is one agency -- the Securities and Exchange Commission, overseen by two committees -- the House Financial Services and Senate Banking, and the courts that define what a security is and not individual crypto exchanges selecting that," Gensler later said. Lawmakers have introduced legislation over the years to regulate crypto. Sens. Kirsten Gillibrand, D-N.Y., and Cynthia Lummis, R-Wyo., have plans to reintroduce legislation next month that would, in part, assert that the Commodity Futures Trading Commission has control over digital asset commodities, such as bitcoin. "I think many of the legislative vehicles would, if adopted, would undermine the securities remit," Gensler added.

Artificial intelligence experts, industry leaders and researchers are calling on AI developers to hit the pause button on training any models more powerful than the latest iteration behind OpenAI's ChatGPT. From a report: More than 1,100 people in the industry signed a petition calling for labs to stop training powerful AI systems for at least six months to allow for the development of shared safety protocols. Prominent figures in the tech community, including Elon Musk and Apple co-founder Steve Wozniak, were listed among the signatories, although their participation could not be immediately verified. "Recent months have seen AI labs locked in an out-of-control race to develop and deploy ever more powerful digital minds that no one -- not even their creators -- can understand, predict, or reliably control," said an open letter published on the Future of Life Institute website. "Powerful AI systems should be developed only once we are confident that their effects will be positive and their risks will be manageable."

Russia is helping Iran gain advanced digital-surveillance capabilities as Tehran seeks deeper cooperation on cyberwarfare, WSJ reported Tuesday, citing people familiar with the matter said, adding another layer to a burgeoning military alliance that the U.S. sees as a threat. From the report: The potential for cyberwarfare collaboration comes after Iran has, according to U.S. and Iranian officials, sold Russia drones for use in Ukraine, agreed to provide short-range missiles to Moscow and shipped tank and artillery rounds to the battlefield. Tehran is seeking the cyber help along with what U.S. and Iranian officials have said are requests for dozens of elite Russian attack helicopters and jet fighters and aid with its long-range missile program.

Russia and Iran both have sophisticated cyber capabilities and have long collaborated with each other, signing a cyber-cooperation agreement two years ago that analysts said focused mostly on cyber-defense networks. Moscow has long resisted sharing digital-offensive capabilities with Iran in the past, for fear they will end up being sold later on the dark web, the people said. Since the start of the war in Ukraine, Russia has provided Iran with communication-surveillance capabilities as well as eavesdropping devices, advanced photography devices and lie detectors, people familiar with the matter said. Moscow has likely already shared with Iran more advanced software that would allow it to hack the phones and systems of dissidents and adversaries, the people said. Russian authorities have determined that the benefits of advancing the military relationship with Iran outweigh any downsides, the people said.

Alibaba To Split Into 6 Companies, Pursue IPOs in Major Shakeup (nikkei.com) 24

Chinese e-commerce group Alibaba Group Holding will reorganize into six business groups and pursue public listings for five of them, in the most significant governance overhaul since the company was established 24 years ago. From a report: The company announced the move on Tuesday, a day after founder Jack Ma's surprise return to China following a lengthy stint abroad. The six business groups will focus on sectors such as cloud computing, e-commerce and logistics. "This transformation will empower all our businesses to become more agile, enhance decision-making, and enable faster responses to market changes," chief executive Daniel Zhang said in a letter to employees. The six new groups will be: Cloud Intelligence Group, Taobao Tmall Commerce Group, Local Service Group, Cainiao Smart Logistics, Global Digital Commerce Group and Digital Media and Entertainment Group.

Each of the groups will be run by its own CEO and board of directors, with the CEOs assuming full responsibility for company performance. Zhang will remain chairman and CEO of Alibaba Group, which will follow a holding company management model. He will also serve as the CEO of the Cloud Intelligence Group, which will be responsible for the company's cloud and artificial intelligence businesses. Zhang became acting president of Alibaba Cloud Intelligence after its cloud service suffered what the company described as "the longest large-scale outage in more than a decade" in Hong Kong in late December.

US Military Needs 7th Branch Just For Cyber, Leaders Say (therecord.media) 120

An anonymous reader quotes a report from the Record: A national association of current and former military digital security leaders is calling on Congress to establish a separate cyber service, arguing that the lack of one creates an "unnecessary risk" to U.S. national security. In a March 26 memorandum, the Military Cyber Professional Association urged lawmakers to establish a U.S. Cyber Force in this year's annual defense policy bill.

"For over a decade, each service has taken their own approach to providing United States Cyber Command forces to employ and the predictable results remain inconsistent readiness and effectiveness," according to the group, which boasts around 3,700 members. "Only a service, with all its trappings, can provide the level of focus needed to achieve optimal results in their given domain," the memo states. "Cyberspace, being highly contested and increasingly so, is the only domain of conflict without an aligned service. How much longer will our citizenry endure this unnecessary risk?"

The creation of a Cyber Force would follow the arrival of the Space Force in 2019. It was the first new branch of the U.S. military in 72 years, bringing the total to six. The association's missive is likely to spark fresh debate on Capitol Hill, where an increasing number of policymakers see a cyber-specific military service as an inevitability. [..] In its memo, the association says that while "steps should be taken to establish such a service, with urgency, pursuing it in a hasty manner would likely prove to be a source of great disruption and risk to our own forces and operations." Therefore, any legislative approval of a Cyber Force should be accompanied by a "thorough study to determine what this military service should look like, how it be implemented, and the applicable timeline," according to the group.

Plans For Royal Mint NFT Dropped By UK Government (bbc.com) 12

Plans for a government backed non-fungible token (NFT) produced by the Royal Mint have been dropped, the Treasury has announced. The BBC reports: Rishi Sunak ordered the creation of a "NFT for Britain" that could be traded online, while chancellor in April 2022. The Treasury announced it was "not proceeding with the launch" following a consultation with the Royal Mint. But economic secretary Andrew Griffiths said the department would keep the proposal "under review."

Responding to the announcement, Harriet Baldwin, chair of the Treasury Select Committee, said: "We have not yet seen a lot of evidence that our constituents should be putting their money in these speculative tokens unless they are prepared to lose all their money. "So perhaps that is why the Royal Mint has made this decision in conjunction with the Treasury."

The Treasury is working to regulate some cryptocurrencies and had planned to enter the NFT market as part of a wider bid to make the UK a hub for digital payment companies. In April 2022, the then-chancellor Mr Sunak said: "We want to see the [cryptocurrency] businesses of tomorrow - and the jobs they create - here in the UK, and by regulating effectively we can give them the confidence they need to think and invest long-term."

Instead of Banning TikTok, Should We Regulate It Aggressively? (msnbc.com) 88

"TikTok CEO Shou Zi Chew testified before the House Energy and Commerce Committee Thursday about safety and national security concerns surrounding his social media behemoth," writes MSNBC, adding "He was not well received." Given what we know about how Big Tech abuses data, about how China's authoritarian government systematically embraces surveillance as a tool of social control, and about the increasingly adversarial geopolitical relationship between the U.S. and China, it's not sinophobic to ask questions about how to guard against TikTok's misuse. It's common sense. While a ban is probably too drastic and may fail to solve all the issues at hand, regulating the company is sensible. Fortunately, one of the key ways to address some of the concerns posed by TikTok — restricting all companies' capacity to collect data on Americans — could help us solve problems with online life that extends well beyond this social media platform....

[Evan Greer, the director at Fight for the Future, a digital rights organization], believes members of Congress laser focused on TikTok are "on a sidequest" in the scheme of a bigger crisis of surveillance of online life; Greer points to the American Data Privacy and Protection Act as a potential solution. That law would put in place strong data minimization policies, strictly limiting how and how much data companies can collect on people online. It also would deal a huge blow to the power of the algorithms of TikTok and other social media apps because their content recommendation relies on collecting huge amounts of data about its users. The passage of that act would force any company operating in the U.S., not just TikTok, to collect far less data — and reduce all social media companies' capacities to shape the flow of information through algorithmic amplification.

In addition to privacy legislation, the Federal Trade Commission could play a more aggressive role in creating and enforcing rules around commercial surveillance, Greer pointed out. TikTok raises legitimately tricky questions about national security. But it's not the only social media company that does, and national security concerns aren't the only reason to rethink the freedom we've given to social media companies in our society. Any time a powerful actor has vast control over the flow of information, it should be scrutinized as a possible source of exploitation, censorship and manipulation — and, when appropriate, regulated. TikTok should serve as the springboard for that conversation, not the beginning and ending of it.

CNN points out that TikTok isn't the only Chinese-owned platform finding viral success in America. "Of the top 10 most popular free apps on Apple's U.S. app store, four were developed with Chinese technology." Besides TikTok, there's also shopping app Temu, fast fashion retailer Shein and video editing app CapCut, which is also owned by ByteDance.
Duncan Clark, chairman and founder of investment advisory BDA China, tells CNN that these apps could be next.

But writing in the New York Times, the executive director of the Knight First Amendment Institute at Columbia argues that "it's difficult to see how a ban could survive First Amendment review." The Supreme Court and lower courts have held repeatedly that the mere invocation of national security is insufficient to justify the suppression of First Amendment rights. In court, the government will have to introduce evidence that the threats it is addressing are real, not merely conjectural, and that the proposed ban would address those threats. The evidence assembled so far is not likely to be sufficient. All of this will no doubt be frustrating to some policymakers, including to some who are commendably focused on the very real risks that social media companies' practices pose to Americans' privacy and security. But the legitimacy of our democracy depends on the free trade of information and ideas, including across international borders.

Long-time Slashdot reader theodp notes Microsoft's friendly relationship with North Dakota, pointing out that in 2017 Microsoft's president Brad Smith said the company would provide the state "cash grants, technology, curriculum and resources to nonprofits" and also "partner with schools to strengthen their ability to offer digital skills and computer science education to the youth they serve." "We just have such a good relationship with the community. We were also excited about Doug Burgum's election as governor. We had confidence that Doug, as governor, would bring a real focus on innovation that would focus on both changes in government and changes in technology." Before being elected Governor in 2016 (with the endorsement of Microsoft CEO Satya Nadella and financial backing from Bill Gates), former Microsoft exec Burgum sold his Fargo-based Great Plains Software business to Microsoft in 2002 for $1.1 billion and joined the software giant, where he reported directly to Steve Ballmer (a college friend) and managed Nadella (who became chief of Microsoft Business Solutions after Burgum's 2007 departure).

"We need a national movement for coding and computer science in our public schools [...] We need to influence, we need to support, we need to reform public policy as we're seeing here in North Dakota," Microsoft's Smith exhorted to TEDxFargo attendees in his return to North Dakota. "We need to make sure that computer science counts towards high school graduation." Mission accomplished. On Friday, North Dakota's governor Doug Burgum and School Superintendent Kirsten Baesler celebrated the governor's signing of HB1398, the Microsoft-supported bill which requires the teaching of computer science and cybersecurity and the integration of these content standards into school coursework from kindergarten through 12th grade. (Two of the ten members of North Dakota's K-12 CS and Cybersecurity Standards Review Committee were from Microsoft).

The superintendent said North Dakota is the first state in the nation to approve legislation requiring cybersecurity education. "Today is the culmination of years of work by stakeholders from all sectors to recognize and promote the importance of cybersecurity and computer science education in our elementary, middle and high schools," superintendent Baesler said at Friday's bill signing ceremony.

Baesler said EduTech, a division of bill supporter North Dakota Information Technology that provides IT support and professional development for K-12 educators, will be developing examples of cybersecurity and computer science education integration plans that may be used to assist local schools develop their own plans. EduTech is a Regional Partner of tech-backed nonprofit Code.org, which also voiced its support for HB1398. Code.org's Board of Directors include Microsoft President Brad Smith and CTO Kevin Scott.

Burgum, who joined Code.org's Governors Partnership for K-12 Computer Science in 2017, was also among 45 of the nation's State Governors who last July signed a Compact To Expand K-12 Computer Science Education in their states in response to a public letter from the CEOs for CS (including Microsoft's Nadella and Smith), part of a campaign organized by Code.org that called for state governments and education leaders to bring more CS to K-12 students to meet the future demands of the American workforce. Code.org has set a goal to make CS a high school graduation requirement for every student in all 50 states by the end of the decade.

Panera Bread Begins Scanning Its Customers' Palms (cbsnews.com) 123

Slashdot reader quonset writes: In an effort to more personalize a customer's experience, the U.S. restaurant chain Panera Bread is rolling out palm-scanning technology which will link the palm print with the customer's loyalty program. According to Panera Bread CEO Niren Chaudhary, the move will allow a "frictionless, personalized, and convenient" evolution of Panera's loyalty program, which boasts 52 million members. The claim is this will allow the company to offer menu choices based on a customer's order history, allow staff to personally greet the customer, and offer further suggestions.

Privacy advocates are not so sure. From the story:

Panera says the technology will securely store its customers' biometric data. However, digital rights activists worry that information could be tapped by federal agencies or accessed by hackers.

"Federal agencies like Customs and Border Protection have experienced devastating hacks where large databases of biometric information have been stolen," Fight for the Future told CBS MoneyWatch in an email. "Do we really expect Amazon, or Panera, to have better cybersecurity practices?"

The scanners are already installed at locations in St. Louis, Panera announced Wednesday, and scanners will "expand to additional locations in the coming months." (Panera has 2,113 locations in 48 states.) "After a simple scan of the palm, Panera associates will be able to greet guests by name, communicate their available rewards, reorder their favorite menu items, or take another order of their choice," the announcement gushes, "extending the guest experience into a true and meaningful relationship.

"When they are done ordering, guests can simply scan their palm again to pay."

Internet Archive Loses in Court. Judge Rules They Can't Scan and Lend eBooks (theverge.com) 96

The Verge reports: A federal judge has ruled against the Internet Archive in Hachette v. Internet Archive, a lawsuit brought against it by four book publishers, deciding that the website does not have the right to scan books and lend them out like a library. Judge John G. Koeltl decided that the Internet Archive had done nothing more than create "derivative works," and so would have needed authorization from the books' copyright holders — the publishers — before lending them out through its National Emergency Library program. The Internet Archive says it will appeal.
The decision was "a blow to all libraries and the communities we serve," argued Chris Freeland, the director of Open Libraries at the Internet Archive. In a blog post he argued the decision "impacts libraries across the U.S. who rely on controlled digital lending to connect their patrons with books online. It hurts authors by saying that unfair licensing models are the only way their books can be read online. And it holds back access to information in the digital age, harming all readers, everywhere.
The Verge adds that the judge rejected "fair use" arguments which had previously protected a 2014 digital book preservation project by Google Books and HathiTrust: Koetl wrote that any "alleged benefits" from the Internet Archive's library "cannot outweigh the market harm to the publishers," declaring that "there is nothing transformative about [Internet Archive's] copying and unauthorized lending," and that copying these books doesn't provide "criticism, commentary, or information about them." He notes that the Google Books use was found "transformative" because it created a searchable database instead of simply publishing copies of books on the internet.

Koetl also dismissed arguments that the Internet Archive might theoretically have helped publishers sell more copies of their books, saying there was no direct evidence, and that it was "irrelevant" that the Internet Archive had purchased its own copies of the books before making copies for its online audience. According to data obtained during the trial, the Internet Archive currently hosts around 70,000 e-book "borrows" a day.

Natural History Museums Join Forces To Produce Global Digital Inventory 6

Dozens of the world's largest natural history museums revealed on Thursday a survey of everything in their collections. The global inventory is made up of 1.1 billion objects that range from dinosaur skulls to pollen grains to mosquitoes. The New York Times reports: The survey's organizers, who described the effort in the journal Science, said they hoped the survey would help museums join forces to answer pressing questions, such as how quickly species are becoming extinct and how climate change is altering the natural world. "It gives us intelligence now to start thinking about things that museums can do together that we wouldn't have conceived of before," said Kirk Johnson, the director of the Smithsonian National Museum of Natural History in Washington and one of the leaders of the project. "It's the argument for networking the global museum."

Scientists had created smaller inventory databases before. But the new effort, which included 73 museums in 28 countries, was unparalleled, experts said. The survey revealed important gaps in the world's collections. Relatively few objects come from the regions around the earth's poles, which are especially vulnerable to the impact of global warming, for example. Insects, the most diverse group of animal species, were also underrepresented.

"The analysis is at a global scale that no one else has managed," said Emily Meineke, an entomologist at the University of California, Davis, who was not involved in the survey. Dr. Meineke said that this survey of large institutions also laid the groundwork for surveys of smaller ones, which might hold even more surprises. "Once these methods are applied down the line to smaller collections, the results are likely to give us a truer picture of biodiversity globally," she said.

Meta Slams Telco Fee Proposal, Says ISPs Should Pay Their Own Network Costs (arstechnica.com) 37

Proposals to pay for broadband networks by imposing new fees on Big Tech companies "are built on a false premise," Meta executives wrote in a blog post today. From a report: "Network fee proposals do not recognize that our investments in content drive the business model of telecom operators," Meta executives Kevin Salvadori and Bruno Cendon Martin wrote. Meta's comments came a few weeks after Netflix co-CEO Greg Peters spoke out against the proposal being reviewed by European regulators. Meta executives said telecom operators and content application providers (CAPs) "are symbiotic businesses, occupying different but complementary roles in the digital ecosystem. Every year, Meta invests tens of billions of euros in our apps and platforms -- such as Facebook, Instagram, and Quest -- to facilitate the hosting of content. Billions of people go online every day to access this content, creating the demand that allows telecom operators to charge people for Internet access. Our investment in content literally drives the revenue and business model of telecom operators."

Internet service providers in the EU argue that Big Tech companies should pay a "fair share" toward network-building costs. In the US, Federal Communications Commission Republican Brendan Carr claims that "Big Tech has been enjoying a free ride on our Internet infrastructure while skipping out on the billions of dollars in costs needed to maintain and build that network." Big Tech companies don't actually get free access to the Internet, though. Anyone distributing content over the Internet pays their own providers, builds their own network infrastructure, or does some combination of the two. For extremely large companies like Netflix and Meta, investments include building their own content-delivery networks. "Over the last decade, CAPs have collectively invested over $880 billion in global digital infrastructure, including approximately $120 billion a year from 2018 to 2021," Meta's blog post today said. "These infrastructure contributions made by technology companies save telecom operators around $6 billion per year."

France Sets EU Precedent With 2024 Olympics Surveillance Arsenal (politico.eu) 31

France's AI-powered array of surveillance cameras for the 2024 Paris Summer Olympics cleared a final legislative hurdle on Thursday. From a report: The French government wants to experiment with large-scale, real-time camera systems supported by an algorithm to spot suspicious behavior, including unsupervised luggage and triggering alarms to warn of crowd movements like stampedes, for the mega-sports event next year. In a sparsely-attended chamber, French members of parliament approved the controversial bill after more than seven hours of heated debate. The text can still be challenged before the country's top constitutional court. Last week, a group of about 40 European lawmakers -- mainly left-wing -- asked their French counterparts to vote against the text. They warned in a letter that "France would set a surveillance precedent of the kind never before seen in Europe, using the pretext of the [2024 Paris Summer] Olympic games."

In the past few months, the plan was also met with intense pushback from digital rights NGOs, including France's La Quadrature du Net, as well as international groups such as Amnesty International and Access Now. Besides privacy concerns, they pointed out a potential conflict with the EU's Artificial Intelligence Act, which is currently under discussion in Brussels and could limit biometric surveillance. The government argues that algorithmic surveillance cameras are necessary to ensure the safety of the millions of tourists expected to visit Paris next year. During the debates Wednesday evening, lawmakers from President Emmanuel Macron's party claimed AI-powered cameras could have prevented the 2016 Nice terror attack by spotting the truck before it could drive into the crowd. They also said it could have helped avoid the security fiasco at the football Champions League final last summer.
